ORLANDO — Two individuals are suing CRP II - Mills Park LLC and Perfection Architectural Systems Inc. for alleged loss of consortium, negligence and liability.

David and Karen West filed a complaint on July 21 in the Orange County Circuit Court, alleging that the defendants failed to follow applicable safety guidelines and regulations.

According to the complaint, the plaintiffs allege that David West suffered bodily injury on July 23, 2013 from being struck by a man lift operated by an agent of the defendants, allegedly resulting in pain and suffering, impairment, disability, inconvenience, disfigurement, mental anguish and the aggravation of a pre-existing condition. His wife claims that she suffered the loss of her spouse's services, support, companionship and consortium.

The plaintiffs hold the defendants responsible for allegedly failing to warn the general public of the hazardous condition, routinely inspect the premises, provide adequate training to their employees and keep the man lift under proper control.

The plaintiffs request a trial by jury and seek judgment for damages against the defendants for compensatory damages, costs, pre-judgment interest and other relief the plaintiffs are entitled to. They are represented by Daniel E. Smith and Kenneth J. McKenna of Dellecker Wilson King McKenna Ruffier & Sos in Orlando.
