Florida Peninsula Insurance Company accused of breaching insurance contract

ORLANDO — An individual is suing Florida Peninsula Insurance Company for alleged breach of contract.

Carlos A. Candamil filed a complaint on July 20 in the Orange County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that his property sustained a covered loss for water damage on March 24. Though the plaintiff allegedly filed a timely notice of the covered loss, the defendant allegedly has failed to sufficiently pay him. 

The plaintiff holds the defendant responsible for allegedly obligating him to retain and pay for the services of a lawyer to represent and protect his interests, and for allegedly refusing to pay the full amount of his insurance claim.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, interest, court costs, attorney's fees and other relief the court deems just. He is represented by David D. Gongora of Law Office of David D. Gongora PA in Orlando.
