ORLANDO — A married couple is suing Target Corporation for alleged loss of consortium, negligence and liability.
Rita and Lloyd Flaker filed a complaint on July 19 in the Orange County Circuit Court, alleging that the defendant failed to provide a safe environment for its customers.
According to the complaint, the plaintiffs allege that Rita Flaker was shopping in the defendant's store on Oct. 10, 2016 when she slipped and fell on a liquid substance that allegedly was on the floor, causing injuries, pain and suffering, disfigurement, mental anguish, medical expenses and the aggravation of a pre-existing condition. Lloyd Flaker claims he suffered an impairment in the services, comfort, society, attention and companionship of his wife.
The plaintiffs hold the defendant responsible for allegedly failing to maintain the area where patrons had access, allowing water to leak and accumulate on the floor and for allegedly failing to inspect or adequately warn Rita Flaker of the danger in the area.
The plaintiffs request a trial by jury and seek judgment for damages in excess of $15,000 against the defendant, interest, costs and any further relief the court deems proper. They are represented by Armando R. Payas of Payas, Payas, & Payas LLP in Orlando.
