Heritage Property & Casualty Insurance Company accused of breaching contract

ORLANDO — An individual is suing Heritage Property & Casualty Insurance Company for alleged breach of contract.

Alberto Cruz filed a complaint on July 6 in the Orange County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that his property suffered damages, including to the building, contents and his possessions. Though the plaintiff allegedly filed timely notice of the damages, the defendant allegedly has not paid any insurance benefits. 

The plaintiff holds the defendant responsible for allegedly obligating him to retain and pay for legal counsel to represent and protect his interests, and for allegedly refusing to pay the full amount of his insurance claim.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, attorney's fees, prejudgment interest, costs and other relief the court deems just. He is represented by Peter Mineo Jr. of The Mineo Salcedo Law Firm PA in Davie.
