Dollar Tree patron alleges raised area in sidewalk caused fall, injuries

ORLANDO – An Orange County woman alleges the condition of a sidewalk at an Orlando retailer caused her to fall.

Denise Colon filed a complaint on June 29 in the 9th Judicial Circuit Court of Florida - Orange County against Dollar Tree Stores Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on April 4, she was shopping at the defendant's store in Orlando when she tripped on an unexpected raised area on the sidewalk and fell. As a result of the accident, plaintiff alleges she sustained bodily injury in and about her body and extremities, disfigurement, disability, mental anguish and incurred medical expenses. 

The plaintiff holds Dollar Tree Stores Inc. responsible because the defendant allegedly failed to warn plaintiff of the danger of the area and failed to correct the dangerous condition of the sidewalk.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages, plus costs, interest, and other relief deemed proper by the court. She is represented by Craig R. Lynd and Jeffrey S. Kaufman of Kaufman & Lynd PLLC in Orlando.
