Ryland Homes accused of breach of warranty, negligence

ORLANDO — A homeowners association is suing the Ryland Group Inc. d/b/a Ryland Homes for alleged breach of warranty and negligence.

Summerport Commercial Property Owners' Association Inc. filed a complaint on June 28 in the Orange County Circuit Court, alleging that the defendant failed to follow applicable safety guidelines and regulations.

According to the complaint, the plaintiff alleges that its members have suffered and continue to suffer damages caused by the alleged defects and deficiencies in the construction of the property, including alleged stucco defects and issues with exterior coverings. 

The plaintiff holds the defendant responsible for allegedly failing to employ good design, engineering and construction practices, comply with the requirements of the Florida Building Code and other local and national codes, as well as allegedly failing to remedy the defects, deficiencies and damages to the property.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages plus costs, pre-judgment interest and other relief the court deems just. The plaintiff is represented by Patrick C. Howell and Scott P. Kiernan of Becker & Poliakoff PA in Orlando.
