ORLANDO — An individual is suing Homeowners Choice Property & Casualty Insurance Company Inc. for alleged breach of contract.

Julia Antoine filed a complaint on June 28 in the Orange County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that her property was damaged on June 27, 2016 directly or indirectly by hail, which allegedly required repairs, replacements, cleaning and other remedial measures. Though the plaintiff allegedly filed a timely notice of the damages to the defendant, the defendant allegedly refused to cover the losses. 

The plaintiff holds the defendant responsible for allegedly failing to establish proof that it was not responsible for the payment of covered losses, and for allegedly failing to pay the requested amounts for repairs and/or replacements.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, interest, attorney's fees, costs and other relief the court deems just. She is represented by Thomas J. Morgan Jr. and Daniel Frank Lopez of Morgan Law Group PA in Coral Gables.
