ORLANDO — An individual is suing Unum Life Insurance Company of America for alleged breach of contract.
Winifred Marshall filed a complaint on June 28 in the Orange County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that she purchased a life insurance to cover her whole family , on Feb. 13, 1999. However, when her spouse passed away, she immediately reported the loss to the defendant, who allegedly refused to acknowledge coverage.
The plaintiff holds the defendant responsible for allegedly breaching its insurance policy by refusing to provide coverage to avoid paying for the claim, and for allegedly requiring the plaintiff to retain and pay for legal counsel.
The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, declaratory relief, interest, statutory penalties, costs, attorney's fees and other relief that the court deems just. She is represented by Randall M. Shochet of Shochet Law Group in Greenacres.
