Vestal & Associates LLC, others accused of violating lease agreement

ORLANDO — A property owner is suing Vestal & Associates LLC d/b/a Scout & Molly's, Elizabeth V. Andert and Christopher M. Andert for alleged breach of a lease agreement.

Swetman Building LLLP filed a complaint on June 27 in the Orange County Circuit Court, alleging that the defendants breached their duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that it suffered damages for having entered into a lease agreement with the defendants on Jan. 14, 2015, which allegedly obligated the defendants to pay monthly rent in exchange for the right to occupy the premises for a period of ten years and three months. However, the defendants have allegedly defaulted under the lease. 

The plaintiff holds the defendants responsible for allegedly breaching the lease agreement by failing to rent for the remaining term of the lease.

The plaintiff requests a trial by jury and seeks judgment against the defendants for damages in the amount of $551,556.53 plus costs, attorney's fees, pre-judgment interest and all other relief the court deems proper. The plaintiff is represented by Frank A. Hamner of Law Offices of Frank A. Hamner PA in Winter Park.
