ORLANDO — An individual is suing American Integrity Insurance Company of Florida for alleged breach of contract.
Dewain W. Jones filed a complaint on June 27 in the Orange County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that he discovered water damage in his insured home on February 25 due to a sudden and accidental pipe leak. Although plaintiff allegedly notified the defendant of the covered loss, the defendant allegedly refused to pay the insurance benefits necessary to repair the property.
The plaintiff holds the defendant responsible for allegedly breaching its insurance contract by allegedly failing to pay for the plaintiff's covered loss, and for allegedly forcing the plaintiff to retain and pay for legal counsel.
The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, interest, attorney's fees, costs and other relief the court deems appropriate. He is represented by Hans Kennon of Morgan & Morgan PA in Orlando.
