Niederst Management Group II Ltd. accused of unjust enrichment

ORLANDO — A Florida company is suing Niederst Management Group II Ltd. for alleged breach of contract and unjust enrichment.

SAB & Company filed a complaint on June 27 in the Orange County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that it suffered damages on May 20, 2016 from entering into a contract with the defendant in which the plaintiff would select the furnishings for several areas on defendant's property. Despite repeated demands allegedly sent by the plaintiff for services rendered, the defendant allegedly refused to pay the amount due. 

The plaintiff holds the defendant responsible for allegedly accepting and retaining the benefit conferred by the plaintiff, and for allegedly failing to pay the plaintiff for services rendered.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages in the amount of $54,541.43, attorney's fees, costs, interest and further relief the court deems just. The plaintiff is represented by Jeffrey S. Elkins of Shutts & Bowen LLP in Orlando.
