ORLANDO — Property owners are suing KB Home Orlando LLC for alleged breach of contract, negligence and liability.
Luis Sierra and Joshua Sierra filed a complaint on June 26 in the Orange County Circuit Court, alleging that the defendant obtained profit through unfair or deceptive trade or commerce.
According to the complaint, the plaintiffs allege that they have suffered damages from construction defects. According to a licensed engineer hired by the plaintiffs to inspect the home, the home allegedly was improperly designed and constructed, including a stucco system that was erroneously installed and other defects that are latent in nature.
The plaintiffs hold the defendant responsible for allegedly failing to comply with all applicable local, state and national building codes and regulations, adhere to industry standards of construction, and for allegedly reducing the value of the property, which allegedly required significant repairs and renovations to correct.
The plaintiffs request a trial by jury and seek judgment against the defendant for damages, together with costs and other relief the court deems just. They are represented by Wil H. Florin, Neil P. O'Brien and Luca G. Esposito of Florin Roebig PA in Palm Harbor.
