RS Elliott Specialty Supply Inc. accuses former employee of violating confidentiality agreement

Contract 05

ORLANDO — A construction distributor is suing Greg Pemoulie, a former employee, for alleged breach of contract.

RS Elliott Specialty Supply Inc. filed a complaint on June 26 in the Orange County Circuit Court, alleging that the defendant breached his duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that it suffered damages to its business and reputation after the defendant allegedly violated a confidentiality agreement by accepting a position with the plaintiff's direct competitor less than a year after resigning.

The plaintiff holds the defendant responsible for allegedly exposing the plaintiff to possible losses in profit from his unlawful activities, and for failing to fulfill his obligations under the agreement.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, temporary and permanent injunction, costs, attorney's fees and other relief the court deems just. The plaintiff is represented by Mark Levitt of Allen, Norton & Blue PA in Winter Park.
