Local Olive Garden restaurant accused of negligence

ORLANDO — A customer is suing Florida SE LLC d/b/a Olive Garden Italian Restaurant #1275, a restaurant owner, citing alleged negligence.

Diane Hoffman filed a complaint on June 26 in the Orange County Circuit Court, alleging that the defendant failed to provide a safe environment for its customers.

According to the complaint, the plaintiff alleges that she was lawfully on the defendant’s premises on Dec. 19, 2014 when she allegedly sustained injuries to her fingers and knees from the restaurant's defective seat. As a result, she allegedly sustained bodily injury, resulting in pain and suffering, significant scaring, mental anguish and the aggravation of pre-existing conditions. 

The plaintiff holds the defendant responsible for allegedly failing to adequately inspect and maintain its dining chairs, and for failing to warn her of the dangerous condition.

The plaintiff requests a trial by jury and seeks judgment for damages against the defendant, costs, interest and other such relief as may be just. She is represented by Scott J. Liotta of Dan Newlin & Partners in Orlando.
