Customer accuses local McDonald's of serving her stale sandwich

CLEARWATER — A restaurant patron is suing JTS Enterprises of Tampa Limited d/b/a McDonald's for alleged breach of implied warranty.

Mona Khavarian filed a complaint on June 30 in the Sixth Judicial Circuit of Florida - Pinellas County, alleging that the defendant failed to provide merchandise fit for human consumption.

According to the complaint, the plaintiff alleges that she was lawfully upon the defendant's premises to purchase a  sandwich on Oct. 9, 2015. While biting into the sandwich, her front tooth allegedly broke, causing her to sustain severe and permanent injury as well as great pain and suffering. The plaintiff holds the defendant responsible for allegedly served her a sandwich that was stale and inflexible.

The plaintiff requests a trial by jury and seeks damages in excess of $15,000 plus the costs of this proceeding. She is represented by Jonathan I. Rotstein of Law Office of Rotstein & Shiffman LLP in Daytona Beach.
