Publix Supermarkets Inc. accused of negligence and wrongful death

CLEARWATER — An estate representative is suing Publix Supermarkets Inc. and John Barber for alleged negligence and wrongful death.

Kimberley Faline, personal representative of the estate of Jean G. Hunt, filed a complaint on June 29 in the Sixth Judicial Circuit of Florida - Pinellas County,  alleging that the defendants breached their duties to maintain their premises in a reasonably safe condition.

According to the complaint, the plaintiff alleges that Hunt was a patron on the defendants' premises on Dec. 18, 2015 when she tripped over a mat and fell to the ground. Hunt allegedly sustained serious injuries that led to her death. The plaintiff holds the defendants responsible for allegedly allowing the existence of a dangerous condition and for failing to warn patrons of the danger.

The plaintiff requests a trial by jury and seeks damages in excess of $15,000 plus costs, interest and all issues triable by jury. She is represented by Hendrick Uiterwyk of Abrahamson & Uiterwyk in Tampa.
