Personal representative accuses Bay Pointe Nursing Pavilion owners of wrongful death

CLEARWATER – A personal representative has filed a wrongful death suit against the owners of a nursing facility.

The estate of Shelia M. Smith through Albert L. Isaac filed a complaint on June 21 in the 6th Judicial Circuit of Florida - Pinellas County against FI-Bay Pointe LLC, Kannon Health Services LLC and Airmid Health Services LLC alleging negligence and wrongful death.

According to the complaint, Smith was admitted to the defendants' Bay Pointe Nursing Pavilion in St. Petersburg in 2013 and resided there until her death in August 2016. Isaac alleges that the defendants failed to monitor Smith's hydration status, failed to provide adequate skin assessments and failed to monitor signs and symptoms of an infection.

The plaintiff holds FI-Bay Pointe LLC, Kannon Health Services LLC and Airmid Health Services LLC responsible because the defendant allegedly failed to properly train staff and failed to provide a safe environment.

The plaintiff requests a trial by jury and seeks disgorgement of profits, consequential damages, interest, attorney's fees, costs and all other relief as the court may deem proper. He is represented by Donna K. Hanes of Wilkes & McHugh PA in St. Petersburg.
