Omega Insurance Company accused of breach of contract

FORT LAUDERDALE — Property owners are suing Omega Insurance Company for alleged breach of contract.

Natalie, Patrick and Andrea Wongsam filed a complaint on June 9 in the Broward County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs allege that their property sustained a covered loss on Nov. 7, 2015 due to a storm-related roof leak. Despite the defendant allegedly acknowledging a covered loss and making partial payment, the plaintiffs claim that the amount is inadequate to cover the damages to the property. 

The plaintiffs hold the defendant responsible for allegedly breaching the insurance policy by refusing to pay the full amounts due and for requiring the plaintiffs to retain and pay for an attorney.

The plaintiffs request a trial by jury and seek judgment against defendant for damages, interest, costs, attorney's fees and other relief that may be appropriate. They are represented by Tracey Foglia of Florida Professional Law Group PLLC in Hollywood.
