FORT LAUDERDALE — A property owner is suing Homeowners Choice Property & Casualty Insurance Company Inc. for alleged breach of contract.
Israel Monteagudo filed a complaint on June 9 in the Broward County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that his property suffered damage Feb. 29, 2016 due to an accidental discharge of water from the kitchen plumbing system. Though the defendant allegedly issued payment for the covered loss, the plaintiff claims that the payments are inadequate to perform the necessary repairs.
The plaintiff holds the defendant responsible for allegedly breaching the insurance policy by failing to pay the full amount and for forcing the plaintiff to retain and pay for an attorney.
The plaintiff requests a trial by jury and seeks judgment against defendant for damages, interest, costs, attorney's fees and further relief the court deems just. He is represented by Erika L. Pardo of the Pardo Law Firm PA in Coral Gables.
