Southern Fidelity Insurance Company accused of breach of contract

FORT LAUDERDALE — A Florida resident is suing Southern Fidelity Insurance Company for alleged breach of contract.

Frances Gordon filed a complaint on June 9 in the Broward County Circuit Court, alleging that the insurer breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that while his property was insured under a homeowners insurance policy, it sustained a covered loss on Feb. 23, 2017 for water damage due to a leaking pipe, which required repairs, replacements, cleaning and other remedial measures. However, despite the plaintiff's alleged efforts to timely notify the defendant of the covered loss, the defendant reportedly refused to pay either part or all of the plaintiff's claim. 

The plaintiff holds the defendant responsible for allegedly failing to establish proof that it was not responsible to pay the covered losses or the requested amounts for repairs and/or replacements.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, interest, attorney's fees, costs and other relief that the court deems just. He is represented by Thomas J. Morgan Jr. of Morgan Law Group PA in Coral Gables.
