FORT LAUDERDALE — A former tenant is suing Jefferson Apartment Group LLC, Jefferson Apartment Development Company LLC, Magdalena Soto and JAG-Star Pompano LLC d/b/a Jefferson at Lighthouse Point for alleged fraudulent concealment, bad faith, civil conspiracy, fraud, negligence, retaliation and unjust enrichment.
Amanda Heine filed a complaint on June 9 in the Broward County Circuit Court, alleging that the defendants obtained profit through unfair or deceptive trade or commerce.
According to the complaint, the plaintiff alleges that she suffered mental, emotional and economic damages on May 5, 2016, including exposure to high levels of cancer-causing radon that resulted in respiratory ailments, headaches, skin lesions and aggravation of a previously existing condition. As a result of the defendants' alleged intentional concealment of the life-threatening levels of radon on their property, which reportedly exceeded safety limits set by the U.S. Environmental Protection Agency.
The plaintiff holds the defendants responsible for allegedly failing to disclose that there were elevated levels of radioactive radon gas, violating building, housing and health codes and failing to inspect and warn the public about the property.
The plaintiff requests a trial by jury and seeks judgment against defendants, compensatory damages, attorney's fees, costs and other relief deemed appropriate. She is represented by Steven G. Calamusa of Gordon & Doner PA in Palm Beach Gardens.
