Universal Property and Casualty Insurance Company accused of failing to pay benefits to policyholder

FORT LAUDERDALE — A homeowner is suing Universal Property and Casualty Insurance Company, citing alleged breach of contract.

Marietta Garrido filed a complaint on June 9 in the Broward County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that she suffered a covered loss on her property on Oct. 17, 2016 due to an accidental discharge of water from a defective plumbing system. However, the defendant reportedly breached the insurance policy contract by denying her claim for benefits. 

The plaintiff holds the defendant responsible for allegedly failing to fully indemnify her for the damages she was entitled to and for requiring her to retain and pay for an attorney.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages in excess of $15,000, plus statutory interest, court costs and attorney's fees. She is represented by Kenneth R. Duboff of Duboff Law Firm in North Miami.
