Florida Peninsula Insurance Company accused of breach of contract

FORT LAUDERDALE — A Florida resident is suing Florida Peninsula Insurance Company for alleged breach of contract.

Taslima Mohammed filed a complaint on June 9 in the Broward County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that his property sustained a covered loss due to HVAC leak on Oct. 1, 2015. However, the defendant has allegedly yet to fulfill its duty under the terms of the insurance policy to cover and pay all of the plaintiff's damages and losses. 

The plaintiff holds the defendant responsible for allegedly requiring the plaintiff to retain and pay for legal counsel to enforce the terms of the policy, and refused to honor its obligations under the policy to fully indemnify the plaintiff.

The plaintiff requests a trial by jury and seeks judgment against the defendant for actual and consequential damages, pre-judgment interest, attorney's fees, costs and other remedies that the court deems just. He is represented by Gabriel O. Fundora and Luis A. Mena of Mena Law Firm in Miami.
