FORT LAUDERDALE — A homeowner is suing Heritage Property & Casualty Insurance Company, an insurance carrier, citing alleged breach of contract.
Christopher Tai filed a complaint on June 8 in the Broward County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that while his property was insured under a homeowners insurance policy, it sustained a covered loss for accidental discharge of water from a plumbing system on Jan. 11, 2017. However, the defendant allegedly failed to pay the full amount.
The plaintiff holds the defendant responsible for allegedly refusing to pay the full amount of the actual cash value of the damages and for forcing the plaintiff to pay for legal fees.
The plaintiff requests a trial by jury and seeks judgment against defendant for damages in excess of $15,000, plus interest, court costs and attorney's fees. He is represented by Kenneth R. Duboff of Duboff Law Firm in North Miami.
