Heritage Property & Casualty Insurance Company accised of not complying with terms of insurance policy

FORT LAUDERDALE — A Florida resident is suing Heritage Property & Casualty Insurance Company for alleged breach of contract.

Firmin Jean-Louis filed a complaint on June 9 in the Broward County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that while his property was insured under a homeowners insurance policy, it sustained a covered loss for water damage in the kitchen on Jan. 28, 2017. However, the defendant allegedly rejected the full amount of the damages and completely denied coverage. 

The plaintiff holds the defendant responsible for allegedly obligating the plaintiff to retain and pay for the services of a legal counsel to represent and protect his interests, and for refusing to pay the full amount of the plaintiff's insurance claim.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages, plus costs, interest and attorney's fees. He is represented by Christopher Aguirre of Strems Law Firm in Coral Gables.
