People's Trust Insurance Company allegedly breached contract by not paying insurance claim

ORLANDO — Two Florida homeowners are suing the People's Trust Insurance Company, citing alleged breach of contract.

Agustin-Manuel Sesto and Carmen L. Sesto filed a complaint on June 16 in the Orange County Circuit Court, alleging that the defendant breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs allege that their insured property sustained a covered loss as a result of wind and water damage that occurred on July 20, 2016. Although the defendant allegedly acknowledged the covered loss and offered payment, the amount paid by the defendant reportedly was inadequate to perform the necessary repairs to the property. 

The plaintiffs hold the defendant responsible for allegedly refusing to pay them the correct amount of insurance policy benefits for the claim or timely pay all amounts due.

The plaintiffs request a trial by jury and seek judgment against the defendant for damages, plus interest, court costs, attorney’s fees and further relief as the court deems appropriate. They are represented by David Low and Sunni Degracia of David Low & Associates PA in Fort Lauderdale.
