Woman alleges uneven floor at O'Maddy's Bar & Grill caused fall

CLEARWATER – A patron of a St. Petersburg restaurant alleges she was injured in a fall because of uneven flooring.

Ashley Schott filed a complaint on June 19 in the 6th Judicial Circuit of Florida - Pinellas County against O'Maddy's Inc., doing business as O'Maddy's Bar & Grill, alleging negligence.

According to the complaint, the plaintiff alleges that on Aug. 19, 2016, she was a business invitee at defendant's property when she tripped over uneven flooring located at the outdoor seating area. The plaintiff alleges she sustained injuries and suffered pain, medical expenses, disability, mental anguish and loss of earning capacity. 

The plaintiff holds O'Maddy's Inc. responsible because the defendant allegedly negligently designed, installed and maintained the uneven and unleveled flooring and failed to warn its guests of the unreasonably dangerous condition.

The plaintiff requests a trial by jury and seeks judgment against defendant for more than $15,000, with interest, costs and all issues triable by jury. She is represented by Eric J. Paolino of Shocklee & Paolino PA in St. Petersburg.
