Homeowner files suit against State Farm Florida Insurance Co. over amount dispute

ORLANDO – The owner of an Orlando property has filed a suit against her insurer over the disputed amount of actual cash damages.

Delia Otero filed a complaint on June 15 in the Orange County Circuit Court against State Farm Florida Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Oct. 7, 2016, her property sustained a covered loss due to a hurricane. The plaintiff alleges she submitted a claim that was accepted by the defendant, but the defendant underpaid the actual cash value of the damages.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages of more than $15,000 plus interest, court costs and attorney's fees. She is represented by Kenneth R. Duboff of Duboff Law Firm in North Miami.
