Hollywood property owners accuse Citizens Property Insurance Corp. of breaching contract

FORT LAUDERDALE – The owners of a Hollywood property allege they have suffered damages because their insurer denied their claim for property damages.

Xiaojuan Jan Gao & Shizhong Lei filed a complaint on June 7 in the 17th Judicial Circuit Court of Florida - Broward County against Citizens Property Insurance Corp. alleging breach of contract.

According to the complaint, the plaintiffs allege that on April 10, while their property was insured under a homeowner's insurance policy, it sustained a covered loss for water damage. The suit states the defendant assigned a claim number and inspected the property but denied the claim.

The plaintiffs hold Citizens Property Insurance Corp. responsible because the defendant allegedly failed to properly adjust the loss and distribute proceeds to return the property to its pre-loss condition and failed to acknowledge or deny that further payment would be forthcoming.

The plaintiffs request a trial by jury and seek judgment against defendant for damages, plus interest, court costs, attorney's fees and expenses. They are represented by Manuel Ramirez of Ramirez Enriquez PLLC in Coral Gables.
