Woman alleges Citizens Property Insurance unlawfully denied property damage claim

FORT LAUDERDALE – A Sunrise homeowner alleges that her home sustained a covered loss and that her insurer wrongfully denied her claim.

Marie Carmen Pierre filed a complaint on June 13 in the 17th Judicial Circuit Court of Florida - Broward County against Citizens Property Insurance Corp. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Dec. 10, 2016, while her property was insured under a homeowner's insurance policy, it sustained a covered loss as a result of a water leak in the kitchen. The suit states the plaintiff submitted a claim, the defendant inspected the property, but denied the claim.

The plaintiff holds Citizens Property Insurance Corp. responsible because the defendant allegedly failed to acknowledge coverage for the loss, failed to acknowledge that payment would be forthcoming and failed to make any payment of the insurance proceeds.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, plus interest, court costs, attorney's fees and further relief as the court deems just. She is represented by David Low of David Low & Associates PA in Fort Lauderdale.
