Property owner claims Citizens Property Insurance Corp. breached contract with claim denial

FORT LAUDERDALE – A West Park property owner has filed a suit against her insurer after her claim for property damages was denied.

Frances Clare filed a complaint on June 13 in the 17th Judicial Circuit Court of Florida - Broward County against Citizens Property Insurance Corp. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Oct. 7, 2016, plaintiff's property sustained direct physical loss caused by wind and/or water. The suit states the defendant denied the claim. 

The plaintiff requests a trial by jury and seeks judgment against defendant, compensatory damages, interest, attorney's fees, costs and further relief as the court deems just. She is represented by Jeremy F. Tyler, W. Wyndham Geyer Jr., Andrew Fuxa and Hillary B. Cassel of Geyer Fuxa Tyler in Sunrise.
