ORLANDO – An Orange County mother alleges her adult son was assaulted by an employee of a residential facility.
Maria Santiago, as guardian of Kelvin Rosa, filed a complaint on June 13 in the 9th Judicial Circuit Court of Florida - Orange County against Central Florida Communities Inc. alleging that the health care facility failed to exercise standard care and skill required of medical providers and facilities.
According to the complaint, the plaintiff alleges that she is a natural parent and guardian of an autistic 24-year-old with developmental disabilities that resided for a time at the defendant's facility. She alleges her son was assaulted by a recently hired employee of the defendant on May 21, 2013, when he didn't follow her demands. The suit states her son sustained a head injury and lacerations to his scalp, eyes, ears and back.
The plaintiff holds Central Florida Communities Inc. responsible because the defendant allegedly failed to determine that the hired employee had criminal arrests relating to violent and aggressive acts, failed to provide a safe and protective environment and failed to provide adequate staff to ensure a resident’s safety.
The plaintiff requests a trial by jury and seeks judgment against defendant for damages that exceed the sum of $15,000. She is represented by Desiree Sanchez of Sanchez Law Group PA in Orlando.
