ORLANDO – A Brevard County man alleges he was injured while working on a Department of Transportation work squad because of slippery algae on asphalt.
John Connelly filed a complaint on June 13 in the 9th Judicial Circuit Court of Florida - Orange County against state of Florida Department of Transportation and State of Florida Department of Corrections alleging negligence.
According to the complaint, the plaintiff alleges that on July 3, 2013, while he was an inmate and part of a DOT work squad, he was instructed by an officer of the defendants to walk to the work squad's truck that was parked in standing water. As a result, the suit states the plaintiff slipped and fell in a large area of standing water, fracturing his right femur and injuring his back and right shoulder. He alleges he was not provided medical care in a timely manner.
The plaintiff holds State of Florida Department of Transportation and State of Florida Department of Corrections responsible because the defendants allegedly allowed water and algae to remain on the premises, failed to maintain and repair asphalt lots and walking areas and failed to move the work truck into a dry and safe location.
The plaintiff seeks judgment against defendants for damages, together with the costs of suit and further relief the court deems proper. He is represented by Gordon Fenderson and Douglas W. Shanteau of Fenderson Law Firm LLC in Jacksonville.
