Homeowner alleges tile damage should be covered by Citizens Property Insurance policy

FORT LAUDERDALE – A Davie homeowner is seeking judgment regarding the insurance coverage for damaged tile.

Gilbert Canton filed a complaint on June 6 in the 17th Judicial Circuit Court of Florida - Broward County against Citizens Property Insurance Corp. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Oct. 1, 2015, he suffered covered losses and damages to his home's tile and other areas caused by a broken water heater. The suit states the plaintiff filed a claim for damages but that the defendant denied it.

The plaintiff is seeking declaratory judgment from the court to establish his right to coverage for the losses.

The plaintiff requests a trial by jury and seeks judgment against defendant,declaratory relief, award actual damages, interest, attorney's fees, costs incurred, and further relief deemed just. He is represented by Jose Selanikio of Gold Litigation PA in Hallandale Beach.
