Winn-Dixie shopper files suit after trip and fall on mat at store

FORT LAUDERDALE – A shopper at a Winn-Dixie in Fort Lauderdale alleges he was injured because of a mat at the store.

Brandon L. Smith filed a complaint on June 5 in the 17th Judicial Circuit Court of Florida - Broward County against Winn-Dixie Stores Inc. alleging premises liability.

According to the complaint, the plaintiff alleges that on Aug. 8, 2016, he was in the premises of the defendant, when he tripped and fell on an irregular rug that was placed on the floor of the store. As a result, plaintiff alleges he suffered bodily injury, resulting pain and suffering, mental anguish, disability, scarring, loss of earnings and aggravation of a previously existing disease. 

The plaintiff holds Winn-Dixie Stores Inc. responsible because the defendant allegedly created a dangerous condition by allowing the mat to remain on the floor and failed to warn plaintiff of the hazardous condition.

The plaintiff seeks judgment against defendant for damages, interest, costs of action and further relief the court deems just. He is represented by Nicholas S. Gurney of Kanner & Pintaluga PA in Boca Raton.
