Nationwide Catastrophe Services Inc. accused of fraud over alleged failure to fix roof

ORLANDO – An Orange County homeowner alleges that a corporation has failed to make repairs to the roof of his home despite being paid.

Francisco Arias filed a complaint on June 8 in the 9th Judicial Circuit Court of Florida - Orange County against Nationwide Catastrophe Services Inc. alleging breach of contract, unjust enrichment, fraud and other counts.

According to the complaint, the plaintiff alleges that on May 10, 2016, he entered into a service contract with the defendant wherein defendant was to negotiate with plaintiff’s insurer for repair and replacement of the roof on plaintiff’s home, which was damaged due to wind, hail and related storm damage. The suit states plaintiff's insurer issued a check for $5,381.21 to the defendant. 

The plaintiff holds Nationwide Catastrophe Services Inc. responsible because the defendant allegedly breached the contract by accepting the insurance proceeds but failed to furnish materials, supply equipment and perform all labor necessary to restore the damage to plaintiff’s home.

The plaintiff requests a trial by jury and seeks judgment against defendant for monetary damages in the amount of $5,381.21, prejudgment interest, court costs and all other relief the court deems just. He is represented by Carlos R. Arias and Frank J. Lacquaniti of Arias Bosinger in Altamonte Springs.
