ORLANDO – The owner of a Winter Garden property alleges that his insurer refuses to honor its contractual obligations to be a protector of his assets and pay for a covered loss.
Carlo Cortes filed a complaint on June 7 in the 9th Judicial Circuit Court of Florida - Orange County against Federated National Insurance Co. alleging breach of contract.
According to the complaint, the plaintiff alleges that on Jan. 27, he suffered a loss due to a water discharge in the kitchen, a covered peril under his property's insurance policy. The suit states that the plaintiff submitted a damage estimate of $42,220.34 but that the defendant rejected this and completely denied coverage.
The plaintiff requests a trial by jury and seeks judgment against defendant, plus costs, prejudgment interest and attorney's fees. He is represented by Jonathan Drake of The Strems Law Firm PA in Coral Gables.
