ORLANDO – An insurance company is accused by a construction company of breaching a homeowner's insurance policy.
Alron Construction LLC, as assignee of Aaron Phelps, filed a complaint on June 7 in the 9th Judicial Circuit Court of Florida - Orange County against Modern USA Insurance Co. alleging breach of contract.
According to the complaint, on June 1, 2015, Phelps' property was damaged by wind, hail and water, and sustained structural damage to the dwelling and incurred additional mitigation expenses. Phelps' property was covered under a policy at the time, the suit states. Phelps sought reimbursement for expenses from the defendant for covered loss, but has not been fully compensated, the suit states.
The plaintiffs hold Modern USA Insurance Co. responsible because the defendant allegedly breached the insurance contract with its refusal of payment for the covered loss.
The plaintiff requests a trial by jury and seeks judgment against defendant for all covered losses with interest on any overdue payments, attorney's fees and cost. They are represented by Katie S. Monroe of Hale, Hale & Jacobson PA in Orlando.
