ORLANDO – An Orlando property owner alleges its insurer has failed to make a determination regarding coverage for weather-related damages.
MM Marriot LLC filed a complaint on June 6 in the 9th Judicial Circuit Court of Florida - Orange County against Security First Insurance Co. alleging that the insurer breached its duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that on Oct. 7, 2016, MM Marriot LLC suffered a loss due to a hurricane, which is a covered peril under the insurance policy from the defendant. It alleges that the defendant has refused to properly investigate the claim and has failed to make a coverage determination.
The plaintiff requests a trial by jury and seeks judgment against defendant for damages, plus costs, prejudgment interest and attorney's fees. It is represented by Jonathan Drake of Strems Law Firm in Coral Gables.
