Couple claims curb at Holiday Inn-Kirkman caused injuries to wife

ORLANDO – A Massachusetts couple has filed a suit against an Orlando hotel after the wife was allegedly injured because of the conditions of a curb.

Denise and Michael Bollettiero filed a complaint on June 6 in the 9th Judicial Circuit Court of Florida - Orange County against Dimension Development Two LLC, doing business as Holiday Inn-Kirkman, alleging negligence.

According to the complaint, the plaintiffs allege that on Sept. 1, 2014, Denise Bollettiero was walking towards the main entrance of the hotel owned by the defendant when she slipped and fell because of the masked difference of height in the curb. As a result of defendant's alleged negligence, Denise Bollettiero sustained permanent injury and future impairment, scarring, medical expenses and aggravation of a pre-existing condition. Michael Bollettiero alleges he has lost the care, comfort and society of his wife. 

The plaintiffs hold Dimension Development Two LLC responsible because the defendant allegedly failed to put warning devices that would help establish the height difference of the curb, and failed to correct or remove the dangerous condition of the property.

The plaintiffs request a trial by jury and seek judgment against defendant for compensatory damages, together with interest and costs. They are represented by Walter A. Ketcham Jr. of Grower, Ketcham, Eide, Telan & Meltz PA in Orlando.
