Woman alleges unbarricaded manhole in St. Petersburg caused her, wheelchair to fall

CLEARWATER – A Pinellas County woman alleges she and her wheelchair were caused to fall because of an unbarricaded manhole in St. Petersburg.

Mary Hatten filed a complaint on May 25 in the 6th Judicial Circuit of Florida - Pinellas County against Verizon Communications Inc., now known as Frontier Communications, alleging negligence.

According to the complaint, the plaintiff alleges that on Jan. 4, 2014, she was traveling in her wheelchair along a street in St. Petersburg and drove over an unbarricaded manhole that was hidden by a puddle. The suit states this caused the wheelchair and the plaintiff to fall.

The plaintiff holds Verizon Communications Inc. responsible because the defendant allegedly failed to inspect the premises for dangerous conditions and failed to warn the public of the existence of a dangerous condition.

The plaintiff requests a trial by jury and seeks judgment against defendant for money damages, costs of suit and all other relief that the court may deem appropriate. She is represented by David A. Papa of Papa & Gipe PA in Clearwater.
