H2O Bagel Express alleged to owe more than $200,000 on lease

FORT LAUDERDALE – A Fort Lauderdale property owner alleges that its tenant has failed to pay rent.

FTL 500 Corp. filed a complaint on May 25 in the 17th Judicial Circuit Court of Florida - Broward County against H2O Bagel Express alleging breach of lease and other counts.

According to the complaint, the plaintiff alleges that on May 5, the defendant defaulted under the lease by failing to pay rent, additional rent and sales tax. The plaintiff holds H2O Bagel Express responsible because the defendant allegedly failed to pay the total amount currently due and owing.

The plaintiff requests a trial by jury and seeks judgment against defendant for unpaid rent and future accelerated amounting to $206,332.83 and additional rent, late fees, interest, attorney's fees, costs and other relief as the court deems just. It is represented by Matthew S. Sackel and Sean M. Smith of Shutts & Bowen LLP in West Palm Beach.
