Pedestrian alleges he was injured at Orlando construction site

ORLANDO – A man alleges he was injured at a construction work site in Orlando.

David and Karen West filed a complaint on June 2 in the 9th Judicial Circuit Court of Florida - Orange County against OHMS Electrical Corp., Debartolo Construction Services, Debartolo Development LLC and Jose Guzman alleging negligence.

According to the complaint, the plaintiffs allege that on July 23, 2013, Guzman, an employee of OHMS, was operating a man lift that collided with David West, a pedestrian. David West alleges that he suffered bodily injury and resulting pain and suffering, impairment, inconvenience, disfigurement, mental anguish, loss of capacity for the enjoyment of life, medical expenses and loss of earnings, while his wife will allegedly suffer the loss of her spouse's services, support, companionship and consortium. 

The plaintiffs hold OHMS Electrical Corp., Debartolo Construction Services, Debartolo Development LLC and Jose Guzman responsible because the defendants allegedly failed to keep the man lift under proper control at all times, failed to keep the man lift he was driving from hitting a pedestrian, and failed to make the work site secure.

The plaintiffs request a trial by jury and seek judgment for damages against the defendants for compensatory damages, costs, interest and any such relief to which plaintiff is entitled. They are represented by Daniel E. Smith and Kenneth J. McKenna of Dellecker Wilson King McKenna Ruffier & Sos in Orlando.
