Ocoee property owners seek coverage of damages from Southern Fidelity Property & Casualty

ORLANDO – Owners of an Ocoee property allege their insurer has not paid their damage claim.

Vicky Pierre and Coles Hyppolite filed a complaint on June 2 in the Orange Circuit Court against Southern Fidelity Property & Casualty Inc. alleging that the insurer breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs allege that on Jan. 8, while their property was insured under a homeowner's insurance policy, it sustained a covered loss for water damage due to a defective plumbing system. However, despite efforts of plaintiffs to furnished timely notice of covered loss, the defendant allegedly refused to pay either part or all of plaintiffs' claim. 

The plaintiffs hold Southern Fidelity Property & Casualty Inc. responsible because the defendant allegedly failed to pay plaintiffs the correct amount of insurance policy benefits for the claim, and failed to timely and promptly pay the full amount due and owing.

The plaintiffs request a trial by jury and seek judgment against defendant for damages of more than $15,000, plus statutory interest, court costs and attorney's fees. They are represented by Kenneth R. Duboff of Duboff Law Firm in North Miami.
