Nassau Bay Apartments tenant alleges construction materials caused fall

ORLANDO – A tenant of Nassau Bay Apartments in Orlando alleges that she was injured after she slipped on construction debris left on a set of stairs.

Olga T. Banks filed a complaint on May 30 in the 9th Judicial Circuit Court of Florida - Orange County against ZMG Construction Inc., Tyrell Enterprises LLC, Dominium Florida Management Services LLC, and Orlando Leased Housing Associates I Partnership, doing business as Nassau Bay Apartments alleging negligence.

According to the complaint, the plaintiff alleges that on Dec. 30, 2013, she left her apartment on the third floor of defendant's property, when she slipped and fell from construction debris as she was going down the dangerous staircase. The suit states that the light was not working above the staircase at the time of the incident. She alleges she injured her right arm, right leg, neck and back.

The plaintiff holds MG Construction Inc., Tyrell Enterprises LLC, Dominium Florida Management Services LLC, and Orlando Leased Housing Associates I Partnership, doing business as Nassau Bay Apartments responsible because the defendants allegedly failed to adequately maintain the property in a reasonably safe manner.

The plaintiff requests a trial by jury and seeks judgment against defendant, for damages and costs of action. She is represented by David R. Best and Matthew D. Best of Best Trial Attorneys PA in Orlando.
