Winter Park property owner alleges Universe Property & Casualty undervalued roof damages

Insurance 08

ORLANDO – A Winter Park man alleges his insurer failed to provide a complete payment for damages to his property caused by a roof leak.

Ernest Alvarado filed a complaint on May 30 in the 9th Judicial Circuit Court of Florida - Orange County against Universe Property & Casualty Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Jan. 22, while plaintiff's insurance policy was in full force and effect, his property experienced a roof leak that caused roof and interior water damage. The plaintiff alleges he timely filed a claim and notified defendant of the loss, but while defendant accepted coverage, the defendant grossly undervalued the extent of the damages.

The plaintiff holds Universe Property & Casualty Insurance Co. responsible because the defendant allegedly refused to honor its contractual obligations in failing to provide complete payment for the plaintiff's loss.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages, prejudgment interest, attorney’s fees, costs and other relief the court deems fair. He is represented by Harold Levy of HL Law Group PA in Fort Lauderdale.
