American Integrity Insurance alleged to have improperly denied coverage for hail damage

ORLANDO – A couple alleges that their insurer improperly denied coverage for hail damages to their Windermere property.

Kyle and Johanna Divirgilio filed a complaint on May 30 in the 9th Judicial Circuit Court of Florida - Orange County against American Integrity Insurance Co. of Florida alleging breach of contract.

According to the complaint, the plaintiffs allege that on May 29, 2016, while insurance to plaintiffs' property was in full force and effect, it sustained covered loss caused by hail. However, despite full cooperation of plaintiff in the investigation of the claim, the defendant allegedly improperly denied coverage for plaintiffs’ loss and claim. 

The plaintiffs hold American Integrity Insurance Co. of Florida responsible because the defendant allegedly refused to honor its contractual obligations in failing to provide complete payment for plaintiffs’ covered loss.

The plaintiffs request a trial by jury and seek judgment against defendant for damages, interest, attorney's fees, costs and other relief as the court deems just. They are represented by Harold Levy of HL Law Group PA in Fort Lauderdale.
