FORT LAUDERDALE – The owners of a Coconut Creek property allege their insurer failed to pay the full amount of actual cash value of a loss.
Waltere Bien-Aime and Sainte Heureuse Bien-Aime filed a complaint on May 23 in the Broward Circuit Court against American Security Insurance Co. alleging breach of policy.
According to the complaint, the plaintiffs allege that on Oct. 13, 2016, while their property was actively insured, it sustained damages from an accidental discharge of water from a plumbing system that failed. Consequently, the defendant allegedly breached the insurance policy contract by refusing to pay the full amount of the actual cash value of the loss, even after admitting coverage for the loss.
The plaintiffs request a trial by jury and seek judgment against defendant for damages of more than $15,000 plus statutory interest, court costs, and attorney's fees. They are represented by Robert A. Reynolds of Duboff Law Firm in North Miami.
