ORLANDO – A shopper at the Macy's store in the Florida Mall in Orlando alleges she was injured because of a bead left on the floor.
Virginia and Edward Rice filed a complaint on May 25 in the Orange Circuit Court against Macy's Florida Store LLC alleging negligence.
According to the complaint, the plaintiffs allege that on Dec. 20, 2014, Virginia Rice was in defendant's store as a paying customer when she stepped on a bead that caused her to slip, trip and fall. As a result of defendant's alleged negligence, she suffered bodily injury and resulting pain and suffering, disability and incurred medical expenses while her husband alleges he suffered the loss of consortium, companionship and comfort of his wife.
The plaintiffs hold Macy's Florida Store LLC responsible because the defendant allegedly failed to promptly clean up the bead and other debris and failed to post proper warning that the area was unsafe to walk in.
The plaintiffs request a trial by jury and seek judgment in their favor for damages of more than $15,000, exclusive of interest and costs. They are represented by Linda L. Schwichtenberg of Linda L. Schwichtenberg PA in Orlando.
