Homeowner alleges Federated National Insurance Co. failed to amend payment

ORLANDO – An Orlando property owner alleges an insurance company failed to adjust a claim payment after she submitted evidence in support of an adjustment.

Mayra Diaz filed a complaint on May 25 in the 9th Judicial Circuit Court of Florida - Orange County against Federated National Insurance Co. alleging breach of insurance policy.

According to the complaint, the plaintiff alleges that on Sept. 13, 2016, her property suffered a direct physical loss while its insurance was in full force and effect and reported the loss to the defendant. The suit states the defendant asserts the damages totaled $2,329.85, but it only issued a payment of $1,829.82 after applying the deductible.

The plaintiff alleges that she disagrees with the defendant's adjustment and payment of the claim and submitted information per the defendant's request, but the defendant has failed and/or refused to amend its position.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages of more than $15,000, plus statutory interest, attorney's fees and court costs. She is represented by Joshua A. Blacksten of Duboff Law Firm in North Miami.
